EUGENE DALEY, being first duly sworn, says:
I am a resident of the City of New York , County of Kings .
On April 14th, 1912, I was one of the passengers on the Steamship "Titanic", at the time of her collision with an iceberg, as set forth in the libel and petition filed herein on October 4th, 1912. By reason of the said collision, and as I am informed and believe, through the fault of the said petitioner, the Oceanic Steamship Company, Limited, or of its agents and servants in charge of the Steamship "Titanic", and without fault on my part, the said Steamship "Titanic" was sunk and became a total loss.
By the said sinking and destruction of said steamship I lost my personal effects, money and property, which went down with said vessel, to the value of upwards of six hundred dollars ($600.)
That a true list or inventory of the articles and effects so lost is annexed hereto, marked "Exhibit A", and is to be taken as part of this claim.
That all and every the articles set forth were owned by me and were in my possession on said steamship and were all totally lost with said ship; and as I am informed and verily believe, no part of said articles has been raised or salved from the wreck.
That the values therein stated are the true and correct market value of the property at the time of said collision, to the best of my knowledge, information and belief.
By the said sinking and destruction of said steamship I was caused and suffered personal injuries to the lower half of my person, which injuries are of a permanent nature, and that by such injuries I have been damaged in the sum of Ten thousand dollars ($10,000.).
WHEREFORE, I present a claim for damages against the said petitioner in these proceedings, to the amount of Ten thousand six hundred dollars ($10,600.), no part of which has been paid.
