HENRY C. BLACKWELL, being duly sworn, says I am executor of the Last Will and Testament of Stephen W. Blackwell, deceased.

The said Stephen W. Blackwell, then a resident of Trenton , Mercer County , New Jersey , was a passenger on the steamship TITANIC at the time of the collision and disaster set forth in the libel and petition herein. By reason of said collision and disaster and as I am informed and believe through the fault and negligence of the said petitioner, the Oceanic Steam Navigation Company, Limited or its servants or agents in charge of the said steamship TITANIC, and without any fault on his part, the said Stephen W Blackwell was injured and killed on April, 15th 1912.

William J. Blackwell and I have duly qualified as the executors of the Last Will and Testament of the said Stephen W. Blackwell and have been granted Letters Testamentary by the Surrogate's Court, of the County of Mercer , State of New Jersey .

Under and by virtue of the laws of the United Kingdom of Great Britain and Ireland and the State of New York, and the State of New Jersey, in such case made and provided, we are entitled to maintain an action to recover damages for the death thus occasioned and we hereby claim One Hundred Thousand ($100,000.00) Dollars as the amount of such damages, no part of which has been paid.

We also claim the further sum of One Thousand ($1,000.00) Dollars, the value of the baggage, moneys and personal effects, which I am informed and believe the said Stephen W. Blackwell had with him at the time of the said collision and disaster, which were totally lost by reason, as I am informed and believe, of the negligence and fault of the petitioner, its agents and servants herein before mentioned and have never been delivered.
